Could Oregon Ducks be deemed repeat offenders?

"According to NCAA rule 19.5.2.3.1, a school "shall be considered a 'repeat' violator if the Committee on Infractions finds that a major violation has occurred within five years of the starting date of a major penalty." The penalty for Oregon's last major violation started May 4, 2004. The Ducks are on the hook for "failure to monitor" starting in 2008. By my math that makes them a repeat offender... bring down the hammer!
